Please read carefully. This Agreement governs the terms by which subscription services are offered through the website located at www.richardduncaneconomics.com (the “Site”).
1. ACCEPTANCE OF TERMS
Welcome to Richard Duncan Economics (“We, Us” or “Our”). We provide our video newsletter services to you (“Services”), subject to the following Terms and Conditions, which may be updated by us from time to time without notice to you. By accessing the Site and using our services, you are agreeing to be bound by these Terms and Conditions and the Richard Duncan Web Site Agreement. If you do not agree with any of these terms, you may not use the Site or our Services.
2. SERVICES
You may subscribe or request our Services as described on our Subscribe page. All fees payable are non-refundable. Prices are subject to change in our sole discretion.
3. MAILING LIST
All subscribers to Macro Watch will be added to Richard Duncan’s mailing list and will receive emails from Richard Duncan. The main purpose of these emails will be to inform subscribers that a new Macro Watch video has been uploaded to the Macro Watch website so that subscribers will know to visit the website in order to watch the new video. Subscribers will have the option to unsubscribe from Richard Duncan’s mailing list at any time. If they do, however, they will no longer receive notifications announcing the new videos. By subscribing to Macro Watch, subscribers understand and accept that they will be added to Richard Duncan’s mailing list.
4. LICENSE TERMS
We hereby grant to you a perpetual, non-exclusive, non-transferable license to use the content of our newsletters (“Content”). All rights in and to the Content, including, without limitation, all copyright and other intellectual property rights relating to the Content, are retained by us. You may use the Content for your personal use however you may NOT:
(a) Claim copyright to any of the Content
(b) Sell or give away the Content.
(c) Sub-license, re-sell, rent, lend, assign, gift or otherwise transfer or distribute the Content or the rights granted under this Agreement.
(d) Reproduce, duplicate, copy, sell, resell or exploit for our Services for any commercial (including any portion of, use or access to the Services).
If you are uncertain whether your proposed use is permitted under this license, please contact us for further guidance.
5. TERMINATION
You agree that we may, in our sole discretion, suspend, terminate or discontinue the Services (your password, account (or any part thereof) and remove and discard any Content within the Services, without notice, for any reason, including but not limited to a violation of these Terms and Conditions. We shall not be liable to you or any third-party for any such suspension, termination or discontinuation.
6. DISCLAIMER
All information provided within the Site and Services is for informational purposes. 9. GENERAL PROVISIONS
(a) Our failure to insist upon or enforce strict performance of any provision of these Terms and Conditions shall not be construed as a waiver of any provision or right.
(b) This Agreement is personal to you and is not assignable by you without our prior written consent.
(c) If all or part of any provision of these Terms and Conditions is deemed unenforceable, the parties or, in the event the parties are unable to agree, a court of competent jurisdiction, shall put in place of such whole or part provision an enforceable provision or provisions, that as nearly as possible reflects the terms of the unenforceable whole or part provision.
(d) You agree to pay and be responsible for any and all sales taxes, use taxes, value added taxes and duties imposed by any jurisdiction as a result of the license granted to you, or of your use of the Content, pursuant to this Agreement.
(e) Recognizing the global nature of the Internet, you agree to comply with all local rules regarding online conduct and acceptable Content. Specifically, you agree to comply with all applicable laws including the country in which you reside or in which you are located.
